Hi
Having been off work on and off for about 20 weeks out of the year!! Due to IC and Uro investigations ( Obstruction) I finally gets a letter this morning from my boss ( Nhs) Blah de Blah!! we are sorry and wish you a speedy recovery!!
feel quite gutted as they know my complaint is a genuine one!! and only last week my Gp wrote a report telling them i would be off till july as i am havinf osteo surgery in june and uro investigations!! that must have been the nail in my coffin because within a week i gets the Dear John!!
Oh well i guess its just a case of getting well and finding another job,

Must be the week for unsympathetic work environments. While my co-workers had no issues with my illness because they know it is legit, the contractor I work for fired me with out any notice on Tuesday.:toosh: I feel gutted as well...as well as hurt since I uprooted my family life to take this job. They told me when I accepted the position that I needed to be in Las Vegas in 2 weeks. I had planned on moving here after Christmas(this past one) but they said they needed me to start immediately. I accomodated them and this is the thanks I get. All the docs I work for are furious, and I am furious with the way it was handled. My husband is going to Iraq, and I have a 3 year old--so this was the perfect position to have while he was gone. So if you need to scream, yell, vent--I'm going through the same thing.

You are not alone. I was fired in July for missing too much work, and not being able to keep up with my work due to the pain. I had not been diagnosed with IC yet, but I'm sure I had it then. My problems started a few years ago, and they finally found out it was IC. I have other medical problems as well, so that didn't help the work situation. Everytime I missed work, I brought in slips from my doctors stating that I had been seen and was not able to return to work until a certain date, but they fired me anyway. But I did get unemployment for 6 months, so I would suggest applying for unemployment since you were terminated. I haven't tried to get another job since then. I would probably just get fired from everywhere else too (that was the 2nd place I got fired from due to illness). I was also forced to quit school because I couldn't keep up. And before all that, my mom had to withdraw me from high school due to medical reasons. I am in the process of filing for disability now, since I finally know what is wrong with me. So that may be a possibility for you too if you don't think you can work. Good luck to you with whatever you decide to do.

Can they fire you in your country if you are ill? Can't you sue them?

I live in Indiana in U.S. Everybody tells me I should sue them for firing me due to illness because it's illegal. But I've also been told that there is no way to prove that they fired me for that reason. They didn't contest my unemployment though, they would not even comment. I don't know much about all that legal stuff.

Ladies it is time to get a lawyer!
It is VERY, VERY important that to do not allow these companies (big or small) to get away with this, it is totaly against Federal LAW TO FIRE YOU FOR ANY ILLNESS. I have a friend here in California that says you have a case and one that is ( A) honerable to persue and (B) a time to fight for your rights.
If it isn't bad enough that we have to fight for good medical care, find Doctors to care enough to treat us with dignity and respect but then we loss our insurance, income and our way of life! It is time to put a stop to this!!
Live is hard enough living with IC for many of us that we should not have to worry every morning when we arrive to work if we still have a place in the company. It doesn't matter if you work as a cashier fast food place or a brain surgeon we all deserve to be treat with human decency!

I do think talking to a lawer about your case is still a good idea. If the lawer thinks you specifically don't have a case so be it....

I did call an attorney and meet with one. He told me they have violated 5 or 6 guidlines of the Americans with Disabilities Act. A few of my docs (bless them) wrote some letters as well stating that I give 150% all the time at work. They also told these meany contractors that I could not be replaced. Anyhoo, the lawyer I talked with stated that we can probably get a judgement for emotional distress and because stress makes me flair, pain and suffering. Oh yeah and by the way, I never received any verbal or written warnings. Bam on a Tuesday afternoon.

with health matters being the way they are !! not only IC but now they feel Thyroid trouble!! what next eh!!
I havent done any investigating about "unfair dismissal ect)
My problem is that i was only there for just under 10 months!! they say 6 is probationary and continued for another 3 to see if my health improved!! which it didnt?? i am wondering IF they are just covering there backs or mayeb they are within there rights to sack me!!
Funnily enough my own Gp was quite shocked and sympathetic to my plight. considering its a doctor that sacked me sad eh!!

Hi guys, I know what you mean and how you feel. I've been put on probation period after probation period because of time missed due to IC and my family is all urging me to call an attorney as well. I just don't know what type of attorney to call.
Last month they told me I wouldn't be reprimanded for any time off whether it be because I wasn't feeling well or to go to my urologist appointments which he is 90 miles from here as long as I made the time up within the same week the abscence occurred and then BAM I get socked with another 30-day probation with the next step being TERMINATION because I failed to be here everyday during my normally scheduled shifts - what a-holes, ya know?
There are looking for anything to hang my hat on. I have a kidney infection right now and doc said I should be off work the rest of the week and I told him NO WAY - don't write the note or I'll be fired for sure. Isn't that nice that when I get sick and the doc gives his orders that I can't abide by them because of work. Everyone tells me what a great job that I do when I'm here and that I can't help that I've been diagnosed with IC and missed so much work do to such a severe illness but the head chiefs here at the college don't see it that way - that's for sure.
I have joined the union and they are helping me fight but there's only so much they can do as well. The union people are saying that maybe I should file a complaint with the ADA and see if that's gets any attention but after reading your posts I'm thinking maybe I should just contact an attorney and see what happens after speaking with him. The worst they can say is that I don't have a case and then I come back and continue to struggle with this place.
I think it's worth a shot, don't you?

I think a talk with an attorney would be a good idea for you. It may be that you can pursue this through your union and the ADA, but I think it's a good idea to cover all bases.

I'm sorry you guys are having such a hard time. I think the probationary period, just covers their you - know - what's!
I work for an at will employer. It means I can be let go for any reason. I signed papers stating that, when I was hired. I'm lucky, I haven't had any issues yet!

I may be wrong on this.. but........ I do believe it is against the law to fire a person while on "medical" leave. I was working and got injured on the job and was on medical and was termiated. That was 14 years ago... I sued and won 25,000.00 (wish I had that now) it may be 2 totally differnt issues tho.. I would check into it.....
I do know how it feels to get fired because of IC, its not fun.. I got fired for spending "quality time in the rest room" oh yea thats where I want to hang out..... gggggrrrr
