View Full Version : EEOC Ruling in NC...good news for others!!

Hi all! Just wanted to let everyone know how my EEOC complaint is going. For those who don't know, here's a quick recap...

I worked for the City for almost 5 years. Last year, I was very sick and had to take FMLA leave. The day my leave ran out (despite my asking them to let me work from home and use donated leave), they fired me. So, in March, I filed a disability discrimination complaint with EEOC.

My investigator called this week and told me that the director has reviewed my case and all the evidence. He found that IC DOES qualify as a disability under EEOC and ADA standards and that the City DID discriminate against me based on my disability. So, the next step is mediation.

This could mean so much for other ICers, especially in NC, as now there will be an official EEOC case on the books where IC was ruled as a disability under the EEOC rules and laws.

I will keep everyone posted on the status of my case. I am working on my list of "demands" for mediation.

Thank you so much for sharing this, Claudia. I also had to take FMLA leave last year and was reassigned to a new position when I returned to work (public school teacher) for the last month of school. It was devastating! Though my new position has turned out to be great, it was so terrible going thru the change to a new school for the last month of school. I'm sorry you were terminated after your FMLA was up. I imagine what you went through was even more devastating than mine. I am so sorry.

I'm going to save this post for future reference, and please keep us posted on what happens and what the mediation involves.

Again, I am so very sorry you were terminated. The stress of THAT I'm sure was not in anyway shape or form good for your state of mind nor your IC. Thanks for sharing this very important information, especially for those of us who work and feel like we have to fight to keep our jobs, despite doing everything possible to work thru it all with IC and its demands.

Yes this is great. Keep us posted. I exhausted all of my FML time this last year. First time in 20 years on the job. I was asked to return to a job I know I could not do, resign or be terminated. I involunatarily resigned due to medical condition. I had met with LTD attorney with a lot of experience he told me my employer had every right to do this after my FML was up. He said I had no case. My father was with me and asked if it was discrimination because of my IC....... he said no.

PM me if you get a chance with the number of this EEOC what does it stand for and how would I go about it here in Michigan.

Claudia,

Did you use up all of your FML time for that leave and then they would not grant you an extension? Or do you use up the whole 12 weeks allowed per Federal law in a calendar or rolling calendar year? Please advice. For me I had used all time allowed in calendar rolling year 12 weeks.
