View Full Version : Hey, hey...I won...after 4 years

I won today...I'm really feeling empty though..I had a bad car acciident last night, I hurt bad (the seatbelt pulled right accross my pelvis and my pelvic floor is in spasms...plus my neckk and all else...yes, my fault but it was an ugly night and someone's car had stalled up ahead...I'll give more details after a nap)
Anyway...my hearing was formal...the judge sat up high in robes...my lawyer spoke with him first, but then I went in sat down and the judge said "I am so sorry to tell you that you are totally disabled, and this should never have taken this long" I just started to bawl. He misunderstood my crying because he started to tell me it wasn't charity, or a hand out...it was insurance I paid ..
So, My private co gets most of the back money (except lawyer fees...and COLA's if I can figure out how that is broken down, if it is) and can take my monthly allotment off what they giveme. Now I have to figure out my childrens settlement. My private company still insists they get the back money, up to where it pays off my insurance payments. (why do we pay premiums if we are expected to pay back the damn benifits) I have to sign a form that states I will take care of their money an will keep records verifying that. In addition, each kid gets a healthy amount each month. AGain, they want to take that of my monthly private payment. Um...ok, my kids payment is in my kid's name...not mine. I can take a bit out for groceriecs and clothing but not really much more.
Any way...I need to sleep. I am tired and don't really feel much right now. :confused: I was hoping I would feel some joy or closure but I'm actually sad but It could be the accident last night.

Thank God you are okay. I almost cried myself when I read what the judge said. I would have bawled also. Maybe you can start on the road to closure now, even if you don't feel it now.

Oh, and he's right, it never should have taken so long. They just now are putting in place a program that fast tracks people in 20 days if they are obviously disabled. Meaning a doc is proactively vouching for them. Bout time.

I am so happy to hear that the judge ruled in your favor!:woohoo: It has been a long time coming! Sorry to hear about the accident. Have you gotten things checked out by a Dr. yet? If not, you definately need to! It sounds like you took quite a beating. I hope you will get thinngs checked out tomorrow. Congrats again on getting approved! Hugs, Amy

thats just great. I am so happy for you.. before my daughter turned 18 I got a check for her for 40.00 a month. That did got to daily living expenses. At the end of each year you will get a paper asking what the money was used for.. lets see 40 a month... Dentist, doctor, rxs, school lunches (we have closed lunches here) clothes, shoes, school pictures, coats boots, hats mittens.. the list contiues.. so you know that money can be used as you see fit... congrats to you I am very happy you finally got a turn in the right direction.
Hope you are feeling better sorry you were in an accident.

have any of you had private ins. and thenhad them demanding past money and counting their money into your household budget.? (you can't, it's for the kids...yes, I'll use about a 100 for food, clothes, ect..) Doesn't matter to them that I have to verify that the back money is for them and I am only a trustee. (it works out to be about 15 grand for each...I know...I had a high paying job and I've been waiting 4 years.) plus about 500 a month for each kid.
My lawyer hugged me and I said "were we done?" he said yes...but I told him I needed help with this extra issue. they have a special person on staff, and I will pay her more to help me. so he told me to call her tomorrow.

Thank you, i am feeling a bit better this afternoon but I hurt like hell. The accident was a strange thing. I take a lot of pain meds but had not taken any except my AM ER morphine, and was about an hour from my PM dose. I was in pain, but just uncomfortable, was jammin to some tunes on my pod I had runningthrough car speakers. The weather was horrid. at that moment I had merged from one freeway to another, and had to immediately get to the center lane. So, the morons are driving past in the left and right lanes going 65 ( I don't drive that fast in GOOD weather ) but the weather was gustying at 35 miles per/hour and the rain blowing in my face from 2 directions. I get in the center lane, there was an optical illusion of a shadow to my left...I glanced, look back to center and everyone stopped. So. It sucked. I guess like 10 secs b-4 someone stalled and it caused people to stop, barely preventing rearending. SO, b/c I was nano secondly distracted, I rearended the Beamer in front of me, he hit the intrepid...and he hit the Impala. What fun. to top it off, i had to pee so bad. I must've been going 35 when I hit, the seatbelt tore across my pelvic area and my pelvic floor.......well....it was wierd...everything like opened, almost felt like tearing. I had a flashback to childbirth. Pulled off, We all checked each other out...the other three were men who were very, very nice. I just started to bawl. Don't know why. I called my husband and he talked me through what to do. I normally knowbut I was so shook up. The police pulled up, saw my disabled tag and collected all my info. They kept asking if I was hurt and I really didn't know. So they sent the other three guys away. Then I had to wait for the tow and the police didn't want to leave me but they had to tend to the stall. He left his # for me. I only waited about 2 mins. But the tow truck had to take my car into East Portland...and drop me off about 3 blocks from where I told my husband to pick me up. SO, there I was, sobbing, hurt, limping and wandering into this restaraunt to wait. The waitress started to say "1 for dinner?" and I just looked her, drowned rat and all...said ..I've been in a bad accident, I soaked , and I really have to pee. She pointed the way.
My insurance company has been very nice...they know I did it and I have to see my chiro and see my pain doc about the damn lapbelt.
I shall see you all later...I am now on to the next phase... once I figure it all out, I am learning how to be a free lance writer...I enjoy it (hell, read some of my tomes I've written, ha, ha,!!!)

Tracey, if you haven't seen a doctor yet, you really should --- you need to be certain you didn't do any internal damage. And I've had a whiplash and I totally understand how painful it can be.

Oh I know I have whiplash. I have topick my head up like a pumpkin every morning, but my chiro wanted the swelling to go down before he worked on me.
My belly on the other hand, has hurt like it did when I first started IC. My reg. doc is in India right now seeing a nephews wedding, my pain doc is in India for holiday's!!!! my uro may see me monday, a friend has Monday's off for a while and will drive me everywhere. So she's taking me to the chiro monday and I will call my Uro on Monday. I've been eating Oxycodone like candy. Well, not that bad, but since I'm very careful about my breakthrough meds, and I'm allergic to Ibuprofen and all other Anti inflammitortories my ER morphine doesn't touch the pain from the wreck, and my breakthroughs are the only thing that does.
Anyway, I found out because it is Social Security, my kids back money gets counted against what I owe to private, and they count their monthly checks against what they pay me. Now, since my eldest will be 18 in 16 months, I wonder if the private company gives me that money back once she's off?
Anyway, I am just hurting today...got to go the shower,

I just saw this thread and how awful you were in an accident. You sure didn't need that to happen. One good thing followed by something bad. I am glad you finally won. :woohoo: They made you work hard enough for it.
